In today's blog article, you will learn under what circumstances and in what amount an employee is entitled to extra pay for split shift and how employees enter it in the program AVENSIO SW.
The split-shift premium compensates employees for the aggravating effects of the specifics of the working arrangements, since splitting a shift into several parts means a greater intrusion into the employee's private life.
Its provision is governed by the provisions of § 130 of Act No. 262/2006 Coll., the Labour Code.
An employee whose employer has scheduled shifts divided into 2 or more parts shall be entitled to a supplement of 30 % of average hourly earningsfor each shift so divided. For these purposes, a split shift means a shift in which the continuous interruption of work or the aggregate thereof is at least 2 hours.
It follows that a split shift cannot be considered a random interruption of work for any reason. The amendment to the Labour Code made by Act No 285/2020 Coll. effective as of 30 July 2020 expressly stipulated that the supplement for a split shift is due to the employee only if he/she works in shifts that have been divided into two or more parts by the employer. Thus, the supplement is not granted to employees who can schedule their own working time or part of it, e.g. in the case of flexible working time.
The provisions of Section 130 of the Labour Code shall applies exclusively to employees in the so-called budgetary and contributory sector, i.e. employees of employers listed in the provisions of Section 109(3) of the Labour Code.
The private employer may negotiate the conditions for the split-shift premium with the employee or set them in the internal wage regulation.
In payroll and HR software AVENSIO SW the split shift premium is usually entered using pay code 451 or another code that each user can create in Wage code table (Main menu - Dialers - Payroll table).
If you require a surcharge to be calculated in the amount of 30% of average hourly earnings, then it is important that the user's payroll code is stored system code 188 and filled in rate 1 = 30. When you enter a payroll item, the number of split shifts entered in days, the program automatically fills in the quantity, calculates the rate and the total amount of the surcharge.
In case of need to calculate the surcharge a fixed amount in CZK, it is necessary to save the user's payroll code system code 187 and fill in the amount for 1 split shift in rates 1 hundred times (e.g. a surcharge of CZK 50 for 1 split shift ? rate 1 = 5000).
When entering a payroll item, the number of split shifts entered in days, the program automatically fills in the quantity, adds the rate and calculates the total amount of the surcharge.
