The time is approaching when many students are trying to take advantage of the summer holidays for various extra jobs and part-time work. Find out what the rules are for employing students in this blog article.
The basic conditions for employing students and minors are that you have reached the age of 15 years of age a completion of compulsory schooling, and it is important to meet both conditions simultaneously. From the point of view of the law No. 117/1995 Coll., on state social support, a child up to the end of compulsory schooling and up to the age of 26 is considered a dependent child if he or she is continuously preparing for a future profession. What is considered to be continuous preparation for a future profession is defined in Section 12 - Section 15 of Act 117/1995 Coll., on State Social Support.
Ways of employing students
Young people and students can work under an employment contract, a work performance agreement or a work activity agreement. However, agreements are the more common way of employing them.
- Employment relationship arises from the closure of employment contracts. The employment contract must be in writing and signed by both the employee and the employer. One copy of the employment contract shall be given to the employee and the other copy shall be retained by the employer. The employment relationship shall be concluded for a fixed period or for an indefinite period. A fixed-term contract may be agreed for a maximum of three years and may be for a maximum of extended twice. The employer must schedule the employee's working hours.
- Agreement on work activity must also be concluded in writing and signed by both parties. The working hours need not be staggered, but the condition that the amount of working time does not exceed half of the organisation's weekly working hours.
- Agreement to perform work must also be agreed in writing and signed by both parties. The condition for the DPP is that the employee must not have worked more than 300 hours in a calendar year, even if there are several FTEs with the same employer.
